Distance Sales Agreement

This agreement is concluded between the Seller and the Buyer for orders placed through the Grace VIP Aesthetics & Beauty Center online shop, in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation. By ticking the “I have read and accept the Distance Sales Agreement” box at the order step, the Buyer is deemed to have accepted this agreement.

Buyer

The consumer who provides their full name, phone, email and delivery address in the order form. This information appears in the order summary.

2. Subject of the agreement

To set out the rights and obligations of the parties regarding the sale and delivery of the products ordered electronically by the Buyer from the Seller's website, whose characteristics and sale price are stated in the order summary.

3. Product information and price

The main characteristics and quantity of the products and the sale price including all taxes are shown in the order summary and in the order confirmation notice. The shipping fee, any free shipping threshold and the total amount are shown to the Buyer at the payment step. Prices are in Turkish Lira. The price at the time of the order applies; later price changes do not affect orders already placed.

4. Payment

Payment is made using one of the methods offered at the order step (bank transfer/EFT, cash on delivery or payment on in-store pickup). For orders paid by bank transfer/EFT, the order number is written in the payment description; the order is prepared once the payment reaches the Seller's account. Orders not paid within the stated period may be cancelled. With cash on delivery, payment is made to the courier on delivery; any additional service fee charged by the cargo company is shown at the payment step.

5. Delivery

Products are shipped by cargo to the address the Buyer specifies in the order form, or handed over at the Seller’s center if the Buyer prefers. Delivery is made within 30 days at the latest from confirmation of payment; preparation and shipping times are communicated in the order confirmation. If the parcel is found to be damaged on receipt, a report should be drawn up and the product should not be accepted. The Seller is not responsible for orders that cannot be delivered because the Buyer is not at the address or the address is incorrect.

6. Right of withdrawal

The Buyer has the right to withdraw from the agreement within 14 days of the date the product is delivered to them or to a person they designate, without giving any reason and without paying any penalty. Notice of withdrawal must be sent within this period to the Seller's email address stated above, WhatsApp line or in writing. The product is returned to the Seller within 10 days of the withdrawal notice, unused, undamaged and in its original packaging. If the right of withdrawal is exercised, the price is refunded within 14 days of the product reaching the Seller, using the method the Buyer paid with (to the account provided, by bank transfer/EFT). 7. Products excluded from the right of withdrawal

Under Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for the following products:

  • Cosmetics, skin care, hair care and personal hygiene products whose packaging, tape, seal or protective film has been opened after delivery (products unsuitable for return for health and hygiene reasons).
  • Products and sets prepared specifically for the Buyer in line with their requests.
  • Products with a short expiry date or that can perish quickly.
  • Products such as gift cards that have started to be used electronically.

For unopened products, the right of withdrawal is valid for 14 days.

8. Defective products

If the delivered product is defective, the Buyer may exercise their optional rights under Law No. 6502 (free repair, replacement with a non-defective equivalent, price reduction or withdrawal from the agreement). Notice of the defect is sent to the Seller within a reasonable time after delivery, together with a photo of the product; in this case, the return shipping fee is borne by the Seller.

9. Protection of personal data

Personal data collected during the order process is processed within the scope of the Personal Data Protection Notice (KVKK) solely to fulfill the order and meet legal obligations.

10. Dispute resolution

For disputes arising from this agreement, the Consumer Arbitration Committees at the place of residence of the Buyer or the Seller have jurisdiction within the monetary limits set each year by the Ministry of Trade; for disputes above these limits, the Consumer Courts have jurisdiction.

11. Entry into force

At the order step, the Buyer declares that they have read and accepted all terms of this agreement. The agreement enters into force upon confirmation of the order; a copy is always accessible on the order confirmation page and on this page.
